City Commission Special Meeting Brief for August 2, 2022

City Commission Reconsiders Prior Direction to Appeal the Circuit Court Order in Cooper City v. Giancarlo (Case No. Cace-CA-009785)
The City Commission voted to reconsider the prior direction it had given the City Attorney and City staff to move forward with an appeal process, after a Circuit Court’s July 25, 2022 ruling that Cooper City District 1 Candidate Joshua Giancarlo was qualified to run for District 1 Commissioner in the upcoming November election.  The City had sought a court ruling to determine whether Mr. Giancarlo had satisfied all qualification requirements.  With the City Commission’s vote to reconsider the decision, during the August 2 Special Meeting, the City Attorney is no longer required to move forward with an appeal of the court decision.  Therefore, the City will not seek any further rulings on this matter and Joshua Giancarlo is qualified to run in the November election under the Circuit Court’s ruling.

City Commission Approves the Purchase of New Fire Engine
The City Commission approved the purchase of a Pierce Custom Enforcer PUC Pumper – 39114 Fire Apparatus.  This purchase comes after several months of careful consideration by the City Commission and staff.   The total cost of this fire engine will be $840,131 plus approximately $25,000 in additional equipment.  The apparatus is expected to be available as early as late January 2023.  The total cost for this apparatus comes with significant savings.  It is approximately $125,000 less than a similar model the City had received an estimate for, and will be available in a much shorter timeframe when compared to the two to two-and-a-half years the City may have had to wait for the aforementioned similar model.  The Broward Sheriff’s Office (BSO) Fire Rescue and Emergency Services brought this fire engine to the City’s attention, while Cooper City’s District Fire Chief has attested that the apparatus is a perfect fit for Cooper City’s needs.  The City’s fire-rescue services are provided by contract with BSO. While BSO provides the staffing and fleet maintenance, the City is responsible for the purchase of the apparatus.  As previously approved by the City Commission on November 30, 2021, this purchase will be funded by the American Rescue Plan Act (ARPA) of 2021 and will leave approximately $1.8 million available for the purchase of additional fire apparatus.
