FINANCIAL MATTERS - PUBLIC HEARINGS | Fiscal Year 2023-2024 Taxes and Budget
1. Ordinance 23-20 – (Finance)
AN ORDINANCE OF THE CITY OF COOPER CITY, FLORIDA, ESTABLISHING THE OPERATING MILLAGE RATE OF 5.8650 OR $5.865 PER THOUSAND DOLLARS OF TAXABLE ASSESSED PROPERTY VALUE, WHICH IS 8.79% PERCENT ABOVE THE ROLLED-BACK RATE OF 5.3909 FOR THE CITY OF COOPER CITY, FLORIDA, PURSUANT TO THE FY2023-2024 CITY BUDGET, IN ACCORDANCE WITH CHAPTER 200, FLORIDA STATUTES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
Commissioner Katzman made a motion to approve Ordinance 23-20, 2nd by Commissioner Green. Motion passed 4-1, Commissioner Shrouder voting no.
2. Ordinance No. 23-21 (Finance)
AN ORDINANCE OF THE CITY OF COOPER CITY, FLORIDA, ADOPTING AND APPROVING THE ANNUAL BUDGET FOR FISCAL YEAR 2023-2024, AND APPROPRIATING THE FUNDS REQUIRED FOR THE OPERATION OF THE CITY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
Commissioner Green made a motion to approve Ordinance 23-21, 2nd by Commissioner Mallozzi. Motion passed 4-1, Commissioner Shrouder voting no. Staff to bring back recommendations for short and long term goals regarding the Optimist and how the fields are maintained.
3. Resolution 23-23 - (Utilities)
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF COOPER CITY, FLORIDA, AMENDING SCHEDULE (A), SCHEDULE (B), AND SCHEDULE (D) OF ORDINANCE NO. 85-10-1, AS AMENDED, RELATING TO MONTHLY WATER RATES, MONTHLY WASTEWATER RATES, AND WATER AND WASTE WATER MISCELLANEOUS CHARGES WITHIN THE CITY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABLITY; AND PROVIDING FOR AN EFFECTIVE DATE.
Commissioner Katzman made a motion to defer Resolution 23-23 to the October 24th City Commission meeting, 2nd by Commissioner Green. Motion passed 5-0

4. Beautification Update - Stefan Bortak, PLA,ASIC - Chen Moore & Associates
Commission consensus to schedule a workshop to discuss the implementation and maintenance of the Landscape and Recreation Masterplan.

9. Motion to reconsider the appointment to the Solid Waste Disposal and Recyclable Materials Processing Authority of Broward County, Florida Governing Board – Commissioner Shrouder
Commissioner Shrouder made a motion to reconsider the appointment to the Solid Waste Disposal and Recycling Materials Processing authority of the Broward County Governing Board, 2nd by Mayor Ross. Motion passed 3-2 Commissioner Mallozzi and Commissioner Green voting no. Commissioner Shrouder made a motion to appoint Mayor Ross as Appointee and Commissioner Shrouder as Alternate, 2nd by Mayor Ross. Motion passed 3-2 Commissioner Mallozzi and Commissioner Green voting no.
10. Discussion on the City's Advisory Board Vacancies - Commissioner Katzman
Discussion had on the City’s Advisory Board vacancies to ensure each board has a full roster and to engage as many residents as possible in the civic process.
11. Discussion and possible action on adding Bingo to the recreation facilities and the formation of a Recreation Foundation - Commissioner Mallozzi
Staff to bring back By-Laws for the Recreation Foundation
12. Discussion and possible action on a proposed ordinance to ban smoking in public parks within the boundaries of Cooper City. - Commissioner Katzman
Commission consensus to direct the City Attorney to draft an ordinance banning smoking in public parks with the boundaries of Cooper City.
13. Discussion and possible action on joining the FP&L Program for underground telephone poles - Commissioner Mallozzi
Commission consensus to research the possibility of joining the FP&L Program for underground telephone poles and for FP&L to come to City Hall to give a presentation. Also, bring back a resolution, one similar to Pembroke Pine’s resolution to remove unused utility poles.
14. Discussion and possible action on the position of Special Magistrate - Commissioner Mallozzi
Commissioner Shrouder made a motion to have staff reach out to Scott Kleiman for Special Magistrate services. Staff to bring back an ordinance to amend the City’s Code in regards to Special Magistrate services. The City Manager will speak with the current Special Magistrate.
15. Discussion and possible action on sports field usage - Commissioner Mallozzi
Commissioner Mallozzi made a motion to allow the Optimist to utilize Field “C”, 2nd by Commissioner Green. Motion failed 1-4, Mayor Ross, Commissioner Green, Commissioner Shrouder, and Commissioner Katzman voting no.
16. Discussion and possible action on revisiting the code for swale trees and tree trimming - Commissioner Mallozzi
Commission consensus to schedule a workshop to discuss the following topics:
- Trees in the swales
- Sidewalk maintenance
- Rear yard/abutting properties
- Tree trimming
- Community walls maintenance
- Other related matters
17. Motion to approve an agreement with Franklin Academy for School Traffic Use.
Commissioner Shrouder made a motion to approve the agreement with Franklin Academy for School Traffic use with the amendment for agreement to expire at the end June 2024, 2nd by Commissioner Katzman. Motion passed 4-1 Commissioner Green voting no.

18. Resolution 23-21 - (Public Works)
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF COOPER CITY, FLORIDA, APPROVING THE AGREEMENT BETWEEN DISH WIRELESS LLC AND THE CITY OF COOPER CITY FOR ONE HUNDRED FIFTY (150) FEET OF GROUND SPACE AT THE TELECOMMUNICATIONS TOWER ON CITY-OWNED PROPERTY LOCATED AT 10300 STIRLING ROAD; PROVIDING FOR CONFLICTS AND AN EFFECTIVE DATE.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF COOPER CITY, FLORIDA, APPROVING AND ADOPTING A COMMISSION MEETING SCHEDULE FOR FY2023-2024, ATTACHED HERETO AS EXHIBIT “A” AND INCORPORATED HEREIN, PURSUANT TO SECTION 2-21 OF THE CITY’S CODE OF ORDINANCES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

CITY MANAGER REPORT
22. Flamingo Gardens Canal Update
Commission consensus to proceed with having the canal sprayed. City Attorney to continue discussions with BCPA in regards to ownership of the canal.
23. Vending Machine Renewal Agreement Update
Staff to bring back information regarding Pepsi and Coke vending machines.
